Save Anees Sous - Father of 6 U.S. Citizen Children - From Deportation to Palestine

He has lived in the United States continuously for the past 27 years. He is the proud father of six United States citizen children and his wife has been approved for permanent residency. But even as his family has legalized their status, Anees Sous is scheduled for deportation on January 20, 2010. His crime? He entered and overstayed a student visa back in 1982 a few months too late for the 1986 amnesty.

Since then, Anees has exhausted all possible remedies, and appealed the fact that he got left out of the I-130 petition filed for his wife, but the courts have refused to grant him relief.

Over the years, Anees has operated a small trucking business and been a strong member of the Dearborn community in Michigan. After living here as a non-criminal resident for 27 years, contributing to our economy and supporting his family financially, how does deporting Anees for the sake of "following the law" make any sense?

Anees and his family, caught up in our broken immigration system, represent the pressing need for comprehensive immigration reform solutions. The only way to save Anees from going back to Palestine and not seeing his family for another 10 years is a deferred action granted by the Department of Homeland Security. Over the past few months, DHS has granted deferred actions to several exemplary long-time residents. There is no reason to deny Anees that exception and to keep this family together.

Time is running out. Please act today to keep Anees with his family.

Avoid Emily Bazar from USA Today: What the Heck is an "Illegal Student?"

Would a truly reputable national newspaper use the N-word to describe African-Americans?

I doubt it.

The USA Today article Groups try to delay deportations of illegal studentsgets it wrong once again by calling immigrant students in the United States “illegal.”

BEWARE: USA Today reporter, Emily Bazar thinks it is alright to label young immigrants without papers as “illegal immigrants” because NumbersUSA and NCLR had a webcast where this was decided. Here is the email to prove this.

But wait, I get the “illegal immigrant” because that slur is familiar. However, WHAT is an “illegal student?”

Emily Bazar (ebazar@usatoday.com), specifically, has also forced undocumented students to reveal their true identity to make a point in her article. For this particular article, Ms. Bazar spoke to our Communications Director and when he told her that she could not use his last name, Bazar retaliated by saying that USA Today had “national standards” and policies to be adhered to. That is amusing, given how even New York Times has been hesitant about revealing the identity of undocumented students. I wonder if these standards come straight from the hate-organization Numbers USA, funded by the known racist John Tanton or FAIR, who is quoted in the article saying the same things that have been debunked here.

Will Seth Williams assist Denis Calderon and Julio Maldonado in any way?

For Denis Calderon and Julio Maldonado (my cousins), it's been 13 years since they were victims of a racial attack; 12 years since they were wrongfully convicted; 9 years since they completed serving their time for that conviction and 9 years since they proved their innocence twice and 5 years since they were arrested by ICE for deportation proceedings as the final blow per se. It's also been 5 years since Seth Williams called this case "his most memorable" while announcing his candidacy for the first time as Philadelphia District Attorney (12/2004 Philadelphia. Weekly)

Today they are still in prison. Denis is serving time in a Federal prison for not assisting in his own deportation and Julio was transferred back to DHS/ICE on 9/11 after serving 4+ years for also not assisting in his own deportation. Aside from the wrongful conviction and it's direct results, these otherwise lawful, long term permanent residents have given up years of their life as innocent men with the trust and faith that justice will prevail.

In their ongoing effort for justice, Denis and Julio's hope remains on receiving a full pardon from Governor Rendell and a cancellation of deportation from DHS.

UFW calls on Schwarzenegger to protect farm workers

BREAKING NEWS: UFW bill reaches Governor's desk. Please take action today.

We've just received word that our bill, SB789 "CA Employee Free Choice Act for Farm Workers" has reached the Governor’s desk. Please drop everything and immediately contact the Governor today.

We've sent this bill to the Governor twice before. We've made and heard all the arguments. The facts are simple. We all understand that California does not have the resources to enforce the laws on the books. They can't protect the more than 500,000 farm workers on 80,000 farms.

Farm workers are literally dying in the fields because they have no water to drink or shade to rest under.  California's inability to enforce the laws has led to pesticide poisonings and sexual harassment on a massive scale.

No heat deaths have ever occurred on any farm where farm workers have a union contract.

End result, this bill will make it easier for farm workers to organize a union and protect themselves. It's time for the Governor to sign it. The Governor has protected agribusiness at the workers' expense for long enough.

Democratic Party Chairman John Burton says, "Before considering any state water deal, lawmakers and the governor must ensure that farm workers have access to clean, cool drinking water and shade.  Current laws guaranteeing drinking water for farm workers are not being enforced, therefore the only recourse for farm workers to protect themselves would be through the collective bargaining process as provided for in SB789."

Nativists target Chatham County NC with their messages of intolerance

There's a war of sorts brewing in Chatham County NC, which towns include Pittsboro and Siler City, home to the majority of North Carolina's poultry processors.

Yep, Willy Gheen and his merry band of armchair radicals have their panties in a wad over a recent resolution passed by the Chatham County Board of Commissioners and the county's Human Relations Commission indicating  strong opposition to any of its law enforcement agencies contracting with U.S. Immigration and Customs Enforcement. (ICE)

The program in question is called the 287(g) program. It authorizes ICE and local law enforcement agencies to enter into an agreement to provide local law enforcement officers with training so they could function under the supervision of sworn ICE officers.

Under the program, every person charged with a crime, whether it's for driving without a license or murder, is asked certain questions to determine if they are legally within the United States. If a person is determined to be an illegal alien, then the person would be held for deportation.

We applaud Chatham County and it's courageous Board of Commissioners and County Sheriff Richard Webster for taking this stand to protect the rights of citizens of Chatham County, both legal and illegal.

You're probably familiar with the 287(g) program and how it has been abused by that media whore, Joe Arpaio of Maricopa County Arizona. Arpaio as completely ignored the out of control crime in his county, where more than 44,000 felony warrants await service, while he galavants around the county harassing folks for "being brown".

Sheriff Webster and his department have better things to do than enforce Federal law and waste the taxpayers money.

Willy Gheen see's it differently though and has issued a "Red Alert" (how silly and juvenile) to motivate his handful of armchair radicals to flood the county offices with faxes, phone calls and emails, demanding "his will be done"!

The vote on this resolution was unanimous.

Sheriff Joe Arpaio loves his new reality show, "Smile ... You're Under Arrest!"

He claims it's "a great merge of entertainment along with law enforcement." ... a humorous cross between "Punked" and "Cops."

Perhaps Fox would like to show this really hysterical clip from a recent episode of the real-life Sheriff Joe show.



What could be more entertaining than watching two small children cry as their mother is taken away forever because she has a broken headlight and an un-paid traffic ticket?

What could be funnier than watching them clutch the stuffed animals that sheriff's trade for their mother in an attempt to quite them down?  

What could be more humorous than the fear and horror on their faces as they plead to be returned to her?  

Come on FOX,  this is the real "reality" of Joe Arpaio. This is what goes on day after day for those who are forced to live in Joe's reality.

Show this video to the American public. Let them see the true face of "America's toughest sheriff"

Come on, don't you think they'd be rolling in the aisles over the funny antics of this modern day Bull Connor.

Mark Krikorian attempts to put lipstick on a pig.

Mark Krikorian, executive director of the right-wing Center for Immigration Studies, has taken to the pages of the National Review to outline what he claims is a new GOP approach to immigration.

Pointing out that for too long Republicans have argued about immigration in terms of "lawbreaking" and illegality, Krikorian suggests instead that a new framing is needed ... a framing he views as a more welcoming and in line with public opinion.

Taking a page from the same playbook that brought us the great Bush oxymoron: "Compassionate Conservatism "...  Krikorian  does The Decider one better and frames out a new right-wing paradox for mass consumption:  "Anti-immigration but Pro-immigrant"

Hold DHS Accountable!

With only days left until the end of the Bush administration, two new rules have been hastily enacted that strike at the heart of the civil liberties of immigrants and asylum seekers. One denies immigrants legal representation in deportation cases, the other mandates DNA tests for all detained immigrants and US citizens who have been accused of a crime, but not convicted.

The American Immigration Law Foundation had this to say about Attorney General Michael Mukasey's last minute decision to deny legal council in deportation cases:

On January 7, 2009, in the waning hours of a departing Administration, Attorney General Michael Mukasey unraveled decades of legal precedent guaranteeing due process to people facing life-changing consequences-namely, deportation.  With less than two weeks left in office, this Administration apparently could not resist the temptation to take one more stab at undermining fundamental Constitutional principles.

In a decision issued Wednesday... the Attorney General declared that henceforth, immigrants, asylum seekers, and all others in removal (deportation) proceedings do not have any right under statute or the Constitution to representation by a lawyer before they can be ordered deported.  The Board of Immigration Appeals (BIA) and most federal courts have for decades operated under the premise that immigrants DO have such rights.  The Attorney General has reversed many years of precedent and operation by simply declaring it so..... his declaration will wipe out the rights of all but a handful of people with one stroke of his pen.

Another Justice Department rule, which took effect Friday, directs federal agencies to collect DNA samples from foreigners who are detained by U.S. authorities.

...the U.S. government will collect DNA samples from people arrested and detained for suspected immigration violations, despite concerns that the move violates their privacy rights.

The new Justice Department policy also will expand DNA collection to people arrested on suspicion of committing federal crimes. Previously, the government only obtained DNA from people convicted of certain crimes.

The American Civil Liberties Union has voiced "grave concerns" about this expansion of governmental DNA collection to include immigrant detainees and those who have not been convicted of any crime.

Barry Steinhardt, director of the ACLU's technology and liberty program said, "People who are merely accused of a crime or a civil violation of law but haven't been convicted of anything are being subjected to the most invasive sort of testing."

These decisions reflect the total disregard for basic Constitutional rights we have come to expect from this administration.

From the warrant-less arrests and detention of not only immigrants, but US citizens, by the DHS, to the kangaroo courts of Postville that denied basic Constitutional protections, our current immigration enforcement system has become so far divorced from the rule of law, it now resembles more the system of a rogue failed-state than the worlds leading liberal democracy.

But we can start to do something about it ... we can demand a return to the true rule of law... One that respects the Constitution and the rights it guarantees.    

Rights Working Group, a national coalition of more than 250 community-based groups and policy organizations dedicated to protecting civil liberties and human rights is urging President Obama to place a moratorium on current immigration enforcement practices in order to conduct a full review of DHS policies and programs to ensure that they are compliant with both Constitutional protections and internationally recognized human right standards.

Dear President-Elect Obama,

I am signing this petition to ask your Administration to address the violations of human rights and civil liberties resulting from ill-conceived immigration enforcement policies pursued by the Bush Administration.  I believe our government should be committed to upholding due process and civil liberties for all people in the U.S., especially when enforcing the law.  Therefore, I urge you to hold the Department of Homeland Security (DHS) accountable to protecting the human rights of citizens and non-citizens alike.

Currently, DHS' immigration enforcement policies use extreme measures to lock up undocumented workers, legal permanent residents and, at times, even U.S. citizens.  Raids of homes and businesses, often without a warrant, have not only steamrolled over Constitutional protections, but also torn apart communities and families.  

Conditions in immigration detention facilities are overcrowded and dangerous and have deteriorated to the point where people are dying in custody from treatable ailments, and people with chronic conditions are not getting the basic medical care they require.

While DHS has taken commendable measures to process numerous naturalization applications delayed by security background checks, over 30,000 such applicants are still waiting to be granted citizenship.  Efficient and transparent mechanisms are needed to ensure that, in the future, all eligible immigrants can attain citizenship in a timely manner.

DHS policies which prioritize the appearance of enforcement over this nation's founding principles of liberty and justice for all do not serve the national interest. I am asking your administration to set clear, enforceable legal standards for DHS operations - standards that uphold the dignity and Constitutional rights of all people in the U.S. - and hold DHS accountable to these standards.  I join the Rights Working Group in urging you to place a moratorium on current immigration enforcement practices in order to conduct a full review of DHS policies and programs to ensure that they are compliant with Constitutional protections and internationally recognized human right standards.

Join the call for the resignation of a bigoted Sherriff in North Carolina

In a recent article in Raleigh's The News & Observer, Johnston County Sheriff Steve Bizzell was quoted accusing Latinos of "breeding like rabbits," calling Mexicans "trashy," and stating, "When people think about illegal Mexicans, you know the first thing they think of?  Driving drunk and shooting."

These are just some of the inflammatory things that Steve Bizzell had to say about Latinos.  As a result, a coalition of progressive groups in North Carolina has asked that the Johnston County commissioners push for Bizzell's resignation.

Nuevo Plan de Aztlan

WHEREAS, We the Chicanas y Chicanos (Xicanos) of the United States of America honor our Native American heritage with all our hearts and minds;  

WHEREAS, We the Chicanas y Chicanos of the United States of America honor the sacred call of our Native American ancestors for peace and justice throughout our Americas; and

WHEREAS, We the Chicanas y Chicanos of the United States of America recognize La Raza has been struggling with a new wave of racial harassment, discrimination and persecution in our Americas since September 11, 2001.

NOW THEREFORE, We the Chicanos y Chicanos of the United States of America resolve as follows:

SECTION 1.  TITLE

This resolution may be cited as Nuevo Plan de Aztlan.

SECTION 2. TERMINOLOGY

Nuevo Plan de Aztlan is based on the following terms:

a)  Americanas y Americanos

Americanas y Americanos are ALL AMERICANS regardless of our races, colors, languages, cultures, nationalities, ethnicities, religions or creeds.

b)  Aztlan

The concept of Aztlan is derived from the Nahua history of the Mexicas before their southern migration from Norte America into Centro Mexico during the 11th Century.  Aztlan today is Indigenas of Mexican-American and(or) Mexican descent who consider ourselves Chicanas y Chicanos regardless of where we were born, live or die.

c)     Carnalismo

Carnalismo is the love and compassion Chicanas y Chicanos have for each other as carnalas y carnales (sisters and brothers).  Carnalismo is what unites and strengthens Chicanas y Chicanos as we work together for peace and justice.

d)  Chicanas y Chicanos

Chicanas y Chicanos are Indigenas of Mexican-American and(or) Mexican descent who consider ourselves Chicanas y Chicanos based on our Native American heritage.

e)  El Movimiento

El Movimiento is the Chicana y Chicano Movement for peace and justice.  El Movimiento is comprised of numerous academic, athletic, artistic, business, commercial, cultural, educational, political, recreational, social, spiritual, wholistic and other Chicana y Chicano organizations and individuals working for peace and justice throughout Aztlan, our Americas and the world.

f)      Heritage

Our Native American heritage includes our ancestral lands and freedoms; and all the histories, cultures, traditions and mores of our Native American ancestors.

g)    Indigenas

Often called Native Americans or American Indians, Indigenas are all the indigenous peoples of our Americas including those of mixed-race heritage like La Raza.

h)  La Causa

La Causa is for peace and justice, the eternal cause of Chicanas y Chicanos who recognize there can be no true peace without true justice, i.e., the abolition of poverty, racism, sexism and all other injusticias in our Americas.

i)  La Raza

Chicanas y Chicanos can be Black, White, Brown, Red, Yellow and(or) any other "skin color" like the rest of La Raza and the human race. The concept of La Raza was derived from a 1925 essay published by Jose Vasconcelos, a Mexican educator who called the millions of mixed-race Indigenas with Latin-American and(or) Latin-European ancestors La Raza Cosmica.

La Raza is comprised of every race, color, nationality, ethnicity, culture, language, religion and creed in the world.  This rich diversity is the unifying power, force and strength of Chicanas y Chicanos, and of all La Raza as we grow to know, understand and honor our great heritage.

j)  Latinas y Latinos

Latinas y Latinos of our Americas are Indigenas with a Latin-American and(or) Latin-European heritage.  Millions of Latinas y Latinos also have African, Asian and other Non-Latin ancestors.

k)  Racism

·Racial categories are crude labels based on parentage and(or) physical traits, not religious or scientific proof of one's superior or inferior nature like racists believe.  

·Racism is the belief one or more "races" are inherently "superior" to one or more other races.  [Example: Many Americans believe "White people" are inherently superior to "Non-White people" and that "Black people" are inherently inferior to all other people.]

·Racism includes the belief "mixed-race" people like La Raza are inferior to those with birth parents of the same race. "Race-mixing" is still condemned by racists today.

· Indigenas were considered savages (less-than-human) when Europeans first invaded and occupied our Americas.  "Christianized" and(or) otherwise assimilated Indigenas are still considered inferior by today's racists.

·Racists are not just poor or poorly educated citizens, there are wealthy and highly educated racists throughout government and society who strive to protect and preserve their privileged status via institutional, industrial and commercial racism.  Racists are not just White, either; there are Brown, Black, Red, Asian and other racists, too.

·The racist imposition of the colonial English language on Indigenas continues to cause horrendous problems for Chicanas y Chicanos in education, employment and virtually all other aspects of life in the U.S.  Laws, rules and regulations are selectively enforced by local, state and federal institutions against La Raza, as English is used as a weapon to deprive Chicanas y Chicanos of liberty, equality and justice throughout our lives.

·Private industry ("free enterprise") also causes havoc for Chicanas y Chicanos by perpetuating racist stereotypes and beliefs about La Raza for profit and gain.  [Example: Mass media and the "entertainment" industries commercialize racist stereotypes and beliefs about Latinas y Latinos throughout the world, while pretending to be "spreading freedom and democracy" alongside the Pentagon.]

l)  Terrorist(s)

A terrorist or terrorists are human beings who use unwarranted violence and(or) the threat of violence to kill, rob, rape, torture, imprison or otherwise impose their will over other human beings.

m) Xicano  

Xicano is the Nahua term for Chicanas y Chicanos.

SECTION 3.  STATEMENT OF PURPOSE

Nuevo Plan de Aztlan addresses the alarming attacks orchestrated against Indigenas throughout Norte America since September 11, 2001 (9/11). U.S. officials are using La Raza as a scapegoat or smokescreen to distract or divert attention away from their heinous war crimes in the Middle East.  

According to their domestic propaganda, the "real problem" and therefore actual enemy or threat to national security is Mexicans and other Indigenas "invading" Norte America, not the Pentagon killing, torturing, maiming, imprisoning and destroying other indigenous peoples' lives in faraway lands.

Thousands of racist media, vigilante, "homeland security" and other hostile actions have been executed against Indigenas since 9/11, as tens of thousands of these indigent men, women and children have been rounded up and herded out of Norte America like cattle.

SECTION 4.  HISTORICAL ANALYSIS

Indigenas have suffered centuries of injusticias including genocide, rape, torture, mayhem, kidnapping, slavery, peonage, poverty, homelessness and groundless imprisonment at the hands of the original European invaders and occupiers of our Americas.

The offspring of these European terrorists expect Chicanas y Chicanos to ignore or forget this true account of their ancestors' horrendous atrocities, as if these abominations against our Native American ancestors never occurred or mattered.  

As English imperialism via the U.S. government seeks to conquer the entire world, La Raza is increasingly faced with discriminatory law enforcement, housing, education, employment, healthcare, mass media, entertainment and other racist industrial, commercial and institutional policies and practices, especially since 9/11.

The offspring of the European terrorists who originally stole our ancestral lands are guilty of receiving this stolen property.  Receiving stolen property is no less a crime than stealing it.  These aliens remain in denial as they continue to exploit, oppress and otherwise deprive us of our ancestral lands and freedoms from generation-to-generation much like their terrorist ancestors did against our ancestors for the past few centuries.

U.S. racists are now working to outlaw MEChA and other Movimiento organizations being blamed for "too many Mexicans" and other Indigenas in Norte America today.  Local, state and federal government agencies have also made it extremely difficult for the Partido de La Raza Unida to rise politically against this institutionalized harassment, discrimination and persecution in any significant way.  

These same racists oppose Chicana y Chicano Studies, affirmative action, financial aid, bilingual and multicultural education, ethnic studies, fair housing, equal employment opportunities and all other ways and means of attempting to create level playing fields for La Raza, as if the U.S. only belongs to Anglo-Americans and everyone else is a second-class citizen at best.  

SECTION 5.  MEXICO, CENTRO Y SUR AMERICA

The 21st Century campaign against Mexicans in the U.S.is also aimed at Chicanas y Chicanos since we are all familia.  Chicanas y Chicanos have a natural, inherent or innate relationship with Mexicanas y Mexicanos because of our common Native American heritage that is everlasting.Other Indigenas throughout our Americas are suffering from these racist attacks too.

We are all being treated as a threat or potential threat to national security by the racist U.S. government at the local, state, federal and international level.

SECTION 6.  GOALS AND OBJECTIVES

a)  We the Chicanas y Chicanos of the United States of America must reach beyond nationalism to establish and(or) coalesce with parallel movements of other Indigenas united around our multilingual, multiracial and multicultural heritage throughout our Americas and on outlying islands.

b)  El Movimiento's mass communication, organization and mobilization initiatives call for Chicanas y Chicanos to join forces with all La Raza against our common exploiters and oppressors because we cannot be free unless and until all La Raza is free.

c)  Economic justice cannot be achieved without social and political justice.  La Raza must join together as an international union of Indigenas to work for this justicia as opposed to permitting the racists to continue to exploit and oppress La Raza via commercial, industrial and institutional racism from generation-to-generation.  

d)  This indigenous union must ensure liberty, equality and justice for all Americanas y Americanos so We can all live, work and travel freely in peace and justice throughout our Americas for so long as the rivers flow.

e)  The first priority of our new union is to abolish poverty, racism and sexism throughout our Americas.

f)  This union must ensure all workers in our Americas receive good jobs and compensation so that all Americanas y Americanos can have nice homes in safe and secure neighborhoods and communities.  People unable to work will also have nice homes in these safe and secure neighborhoods and communities because no one will live in poverty or homelessness in our Americas except by her or his own choosing.

g)  We the Chicanas y Chicanos of the United States of America must ensure our children learn about our indigenous ancestors, at home and in all the schools, colleges and universities of our Americas so they and future generations will know, understand and honor our Native American heritage.

NOW THEREFORE BE IT RESOLVED, We the Chicanas y Chicanos of the United States of America will live our daily lives in accordance with Nuevo Plan de Aztlan to the best of our abilities.

BE IT FURTHER RESOLVED, We the Chicanas y Chicanos of the United States of America will encourage Chicana y Chicano organizations everywhere to review, adopt and incorporate Nuevo Plan de Aztlan into their own missions, goals and objectives so all Indigenas can stand united against the new wave of racial harassment, discrimination and persecution La Raza faces in the 21st Century.

Remember Postville, Iowa?

On May 12th ICE agents raided the Agriprocessor plant in Postville, Iowa and detained nearly 400 men, women and children. Here's a video of Sister Mary McCauley of St. Bridget's Catholic Church talking about the impact of this raid on their small community and the efforts of the church to provide assistance.

I have a friend who is the director of an organization here in the Twin Cities, Centro Legal, that provides legal assistance for the immigrant communities in the area. Today I got an email pointing me to the following letter asking for assistance for this small town that has been devastated.

ACTION: AZ Superintendent to Abolish Ethnic Studies Program

Today, I read an article from Latina Lista about Tom Horne, a school superintendent in Tuscon, Arizona who wants to do away with an ethnic studies program at a local High School. The classes he's looking to eliminate include African American studies, Native American studies, Mexican American/Raza studies and Pan Asian studies.

Horne, who claims to have a long history of "opposing ethnic studies and gender studies" says that the decision is "not based on a question of academics or education, but 'values.'"

The classes he's proposing for elimination have been proven to help Latino students at the high school perform at higher levels.

Countless studies of such classes have shown that such programs don't just enrich the curriculum but broadens the knowledge base of the students and fosters a sense of pride.

Action Alert - North Carolina Banning Undocumented Students

North Carolina alone is moving ahead with an interpretation of a federal law that the state says bars illegal immigrants from attending community colleges, even if the students pay more than the cost of their education.

The new policy, (PDF) approved May 13 by the North Carolina Community College System, comes after six months of political and legal controversy on the topic, but it is unlikely to be the last word in an area where federal courts and immigration officials have offered little guidance to states.

Practically speaking, the decision’s effect will be limited. It doesn’t apply to students attending English as a Second Language classes or vocational training, for instance. Only 112 North Carolina community college students who pursued academic credit last year - out of a total of 296,520 - likely were illegal immigrants, according to the community college system.

But symbolically, the policy is “insulting” to Latinos, said Tony Asion, executive director of El Pueblo, a Raleigh-based non-profit group focused on developing the Latino community. He pointed out that, before the change, undocumented students were allowed to enroll but had to pay out-of-state tuition, which is set at 40 percent above cost that the colleges spend to educate them. Other North Carolina residents get a discount.

Admitting undocumented students “isn’t taking any money from anyone. It isn’t taking any (class) space from anyone. The reason (for the change) is: ‘We just don’t want these people in our schools,’” Asion said.

Sample letter to send to your representatives:

This is in regards to the proposal to ban undocumented students from higher education institutions in North Carolina. We firmly oppose this move as it is a wrong interpretation of federal immigration law, a waste of public resources and serves no compelling state interest.

The Attorney General of North Carolina has wrongly interpreted the 1996 federal law, spinning it to mean that undocumented students should be denied postsecondary education benefits when the law only states that undocumented students shall not qualify for any post-secondary benefit that are not already available to U.S. citizens and nationals. Post-secondary education, in and of itself, is already available to all U.S. citizens and nationals.

Additionally, an ICE memo recently clarified that United States federal law did not prohibit undocumented students from attending colleges in America—the matter is up to the sole discretion of the postsecondary educational institution.

Here is a look at undocumented students in North Carolina by the numbers that shows how admitting undocumented students is a net-benefit, a profit-making opportunity for higher education in North Carolina:

  • 27 - UNC system students who are illegal immigrants, out of 200,000

  • 340 - Community college students who are illegal immigrants, out of 271,000

  • $5,300 - Annual cost of educating a full-time student at a community college

  • $7,465 - Out-of-state tuition illegal immigrants pay at community college

Since undocumented students make up less than one-tenth of one percent of students in the North Carolina system and do not burden taxpayers because they are not eligible for financial aid or grants, it would be ludicrous not to educate them. Moreover, since they have to pay ‘out of state’ tuition, it more than covers the cost of their enrollment. There can be no justification for denying higher education to students–regardless of immigration status–if they merit those spots under status quo federal and state law.

CA Bill Aimed at Assisting Immigrant Victims of Domestic Abuse

Earlier this year Assemblymember Juan Arambula introduced a bill, CA AB 2405, that would provide funding to "domestic violence prevention programs that [would] focus on assisting women who are immigrants or refugees or women who live in rural communities" to the California State Assembly.

The purpose of the bill is to assist domestic violence programs that will help address the barriers many immigrant women face living in the rural areas of California. Female immigrants, especially those in rural areas, are the most deprived of resources in dealing and recovering from domestic violence abuse. Immigrant women, like other abused women, may depend on their abusers for financial support, and breaking free of dependency is never easy. If they do escape, many of them face barriers, which often include language difficulties and cultural communities that discourage victims from talking about the abuse.
